This Refund Policy applies to all Mucci Strength LLC ("Mucci Strength," "we," "us," or "our") high-ticket coaching enrollments. By signing the client agreement and beginning the program, the Client agrees to the terms set forth below. This policy is incorporated by reference into our Terms of Service and the signed client agreement.
The Performance Guarantee described in Section 3 is the sole and exclusive path to a refund of payments made under a coaching enrollment.
Mucci Strength is a coaching and fitness performance company. We do not provide medical advice, diagnosis, or treatment, and our coaches are not licensed medical professionals, physical therapists, or chiropractors. The PAP system and all program content are educational and performance-based in nature and are not a substitute for professional medical care.
The Client acknowledges that they have consulted, or have had the opportunity to consult, a qualified physician before beginning the program, and that they are physically capable of participating. The Client agrees to disclose any relevant medical conditions, injuries, or medications at intake and to notify Mucci Strength promptly of any changes during the program. The Client assumes all risks associated with physical training and pain-related coaching outcomes.
By signing the client agreement and beginning the program, the Client commits to the full program length and the full investment outlined in their agreement. Mucci Strength does not issue refunds, partial refunds, or pro-rata refunds for unused portions of the program outside the Performance Guarantee in Section 3 below.
Coaching is delivered as a continuous service. Custom program design, weekly 1-on-1 calls, video form review, daily text access, and community membership are delivered from day one and cannot be returned.
Mucci Strength stands behind the PAP system. If the Client completes the full program length outlined in their agreement and has not experienced a meaningful reduction in pain from their documented baseline, the Client is eligible for a full refund of all payments made plus 30 days of additional coaching at no cost, subject to the conditions below.
Defining "meaningful reduction in pain." At program intake, the Client and their assigned coach jointly establish a baseline pain assessment using a 0 to 10 scale across the Client's primary pain points and movement patterns. The baseline is documented in writing. Meaningful reduction in pain is defined as either (a) a minimum 30% reduction in average pain score from baseline by the end of the program, or (b) full resolution of the Client's primary documented complaint. Pain scores are self-reported by the Client and logged during weekly 1-on-1 check-ins.
Compliance requirements. To qualify for the Performance Guarantee, the Client must demonstrate full engagement with the program:
Failure to materially comply with the above requirements, as determined by Mucci Strength in its reasonable discretion, voids eligibility for the Performance Guarantee.
Process and timing. To claim the Performance Guarantee, the Client must submit a written request to Mucci Strength within 14 days of completing the program. Mucci Strength will review the Client's compliance record, baseline assessment, and weekly pain logs to verify eligibility. The review and approval decision will be made within 14 days of receipt of the request. If approved:
Medical pause. If the Client experiences a documented injury, illness, or medical event during the program that prevents continued participation, Mucci Strength may, in its sole discretion, pause the program timeline and extend the Client's access for an equivalent period. Approved pauses do not shorten the program length for purposes of the Performance Guarantee, do not waive compliance requirements during active program weeks, and do not independently entitle the Client to a refund. Pause requests must be submitted in writing with supporting documentation.
Program completion. For purposes of this policy, "completion of the program" means the end of the final week of coaching as defined in the Client's signed agreement, inclusive of any approved pauses or extensions.
Limitations. The Performance Guarantee applies only to Clients who complete the full program length, meet all compliance requirements, and submit a timely claim. The guarantee does not apply to Clients who voluntarily cancel before program completion, are removed for non-payment or violations of community standards, or fail to maintain documented engagement throughout the program.
If the Client is on a payment plan and a scheduled payment is missed, Mucci Strength may revoke access to coaching, the community, and program materials. The remaining balance under the signed agreement remains due in full. Missed payments do not entitle the Client to a refund of payments already made.
The Client agrees to use the refund process described in this policy as the sole method for resolving any payment dispute. Initiating a chargeback, payment dispute, or reversal with a credit card company, bank, or payment processor without first completing the Performance Guarantee claim process constitutes a material breach of this agreement. In the event of an unauthorized chargeback, Mucci Strength reserves the right to (a) revoke all program access immediately, (b) pursue collection of the disputed amount, and (c) recover related costs, including processor fees, collection costs, and reasonable attorneys' fees.
This Refund Policy and the Client's enrollment are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to this policy, the client agreement, or the program shall be resolved by binding arbitration administered by JAMS in New Jersey, in accordance with its Streamlined Arbitration Rules and Procedures. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
The Client and Mucci Strength each waive the right to a trial by jury and the right to participate in any class, collective, or representative action. All disputes must be brought in the party's individual capacity.
